1. Scope of Application

1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of the company Mevalon-Produkte e.K.
Inhaber: Vladimir Vukovic (hereinafter referred to as “Seller”) shall apply to all contracts concluded between a consumer or a trader (hereinafter referred to as “Client”) and the Seller relating to all goods and/or services presented in the Seller’s online shop. The inclusion of the Client’s own conditions is herewith objected to, unless other terms have been stipulated.

1.2 These GTC apply accordingly to contracts for the provision of license keys, unless otherwise agreed. In this respect, the Seller owes the provision of a license key for the use of the digital content or digital services described by him (hereinafter “digital products”) as well as the granting of the contractually agreed rights to use the respective digital products. The Client does not acquire any intellectual property rights to the digital product. The respective product description of the Seller is decisive for the quality of the digital product.

1.3 A consumer pursuant to these GTC is any natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity.

1.4 A trader pursuant to these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

2. Conclusion of the Contract

2.1 The product descriptions in the Seller’s online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Client.

2.2 The Client may submit the offer via the online order form integrated into the Seller’s online shop. By completing the order process and clicking the button finalizing the order, the Client submits a legally binding offer of contract.

2.3 The Seller may accept the Client’s offer within five days:

  • by written order confirmation (e-mail, fax), or
  • by delivering the goods, or
  • by requesting payment

The contract is concluded at the time one of these actions occurs. If no acceptance occurs within this period, the offer is considered rejected.

2.4 The contract text is stored by the Seller and sent to the Client after the order.

2.5 The Client can correct input errors before submitting the order using standard input methods.

2.6 The contract is concluded exclusively in English.

2.7 Communication is typically handled via e-mail. The Client must ensure the provided e-mail is correct and accessible.

3. Right to Cancel

3.1 Consumers are entitled to the right to cancel.

3.2 Details are provided in the Seller’s cancellation policy.

4. Prices and Payment Conditions

4.1 Prices include VAT unless stated otherwise. Shipping costs are listed separately.

4.2 Payment methods are available as listed in the shop.

4.3 PayPal
Payments may be processed via PayPal, including credit checks and assignment of claims where applicable.

4.4 Klarna (Instant Transfer)
Handled by Klarna Bank AB. Requires online banking verification.

5. Shipment and Delivery Conditions

5.1 Delivery is made to the address provided by the Client.

5.2 If delivery fails due to Client fault, return costs may apply.

5.3 Personal collection is not available.

5.4 Licence Keys Delivery:

  • via e-mail
  • via screen display
  • via download

5.5 Seller may withdraw in case of supply issues.

6. Granting Rights of Use for Licence Keys

6.1 License keys allow usage as defined in the product description.

6.2 Rights are granted only after full payment.

7. Reservation of Proprietary Rights

Ownership remains with the Seller until full payment is received.

8. Warranty

8.1 Statutory warranty rules apply unless otherwise stated.

8.2 For traders:

  • Seller chooses remedy type
  • 1-year defect period for new goods
  • no warranty for used goods

8.3 Exceptions:
No limitation applies in cases like:

  • damages
  • fraud
  • construction-related defects
  • digital product update obligations

8.4 Statutory recourse rights remain unaffected.

8.5 Traders must inspect goods and report defects (HGB §377).

8.6 Consumers should report transport damage immediately.

9. Liability

9.1 Unlimited liability in cases of:

  • intent or gross negligence
  • injury to life, body, health
  • guarantees
  • mandatory legal liability

9.2 Liability for minor negligence is limited to foreseeable damage.

9.3 Otherwise excluded.

9.4 Applies also to representatives and agents.

10. Applicable Law

German law applies, excluding international sales law.
Consumers retain protection of their country of residence.

11. Place of Jurisdiction

  • Seller’s location is jurisdiction if Client is a business
  • Applies also internationally if tied to business activity
  • Seller may also choose Client’s jurisdiction

13. Alternative Dispute Resolution

Seller is not obligated to use ADR but is willing to participate.
